When these efforts fail, submiting a complaint with an administrative agency that has enforcement power is a next step prior to filing a personal lawsuit.
Each agency has its own process.
DOJ enforces Title II - State and Local Government and Title III - Public Accommodations of the Americans with Disabilities Act (ADA) . They may take action against organizations or individuals who violate a disabled person's rights to equal access to programs, goods and services. A complaint must be filed within 180 days of the alleged ADA violation.
EEOC enforces Title I - Employment of the Americans with Disabilities Act (ADA) They may take action against private employers, state and local governments, employment agencies, and labor unions with 15 or more employees. A complaint must be filed within 180 days of the alleged ADA violation.
Unlike Title II and III of the ADA, Title I does not specifically mention service animals. Employees must ask for a reasonable accommodation and participate in the interactive process before bringing the service animal.
HUD enforces civil rights law. They may take action against organizations or individuals who violate a disabled person's civil rights when buying or renting a home or apartment, seeking housing help, getting a mortgage, or engaging in other housing-related activities. A complaint must be filed within one year of the last date of the alleged FHA violation.
DOT enforces the Air Carrier Access Act - ACAA. They may take action on discriminaiton against organizations or individuals who violate a disabled person's civil rights who operate U.S. airlines flights within the U.S. and foreign airlines who operate flights to or from the United States. A complaint must be filed within 180 days of the alleged FHA violation.
The Commission enforces Florida civil rights laws. They may take action on discrimination in employment, housing and some places of public accommodation. A complaint must be filed within 365 of the alleged violation.
